This application for an ECA is a classic example of why municipalities/communities find it so difficult to trust corporations as community partners. This particular application is even worse as there appears to be both non-compliant progressive rehabilitation of an aggregate pit on the part of the property owner, together with what appears to be non-compliant land use by the company (Badger) apparently leasing the land. This apparently non-compliant and potentially environmentally toxic land use by Badger has been ongoing for years risking both the property owner's aggregate license status and the leasing corporation's (Badger) legal position regarding the environment. It has been brought to the attention of the Ministry of the Environment and now the Ministry of Natural Resources by the Township of Puslinch, with little response from the Ministry of the Environment.
This shouldn't be complicated. Puslinch Township is not a property on a Monopoly board and even if it was, we shouldn't reward corporations apparently acting illegally, with "get out of jail free" cards. It's simple! Until such time as the Ministry of the Environment investigates the situation and establishes Badger's position with respect to past land use compliance, no consideration should be given to any further Badger application's, ECA or other, regarding this property.
