Thank you for the opportunity to comment on ERO Posting 019-9220.

The Nottawasaga Valley Conservation Authority (NVCA) provides the following comments.

The subject lands are partially regulated under Ontario Regulation 41/24 (Prohibited Activities, Exemptions and Permits) due to flood and meander erosion hazards associated with Innisfil Creek and one of its tributaries. An NVCA permit will be required for any development within the regulated areas on the subject lands.

As per the South Georgian Bay Lake Simcoe Source Protection Plan, the property is not within a Wellhead Protection Area. Portions of the property are mapped as being within a Significant Groundwater Recharge Area and Highly Vulnerable Aquifer. The NVCA Risk Management Official has reviewed the development concept and related external servicing works requiring an Environmental Compliance Approval from the Province and has no concerns with the development from a source protection perspective.

The NVCA is currently reviewing the active Site Plan Control application for the development of the casino. Through this application and review, the limits of the hazardous lands on the property will be confirmed. The NVCA is requesting that any MZO issued for the subject lands only permit development on those lands determined to be outside of any natural hazard. The NVCA will provide a copy of the NVCA approved site plan showing the limits of the development to the MMAH Municipal Services Office - Central Region and mmahzoningorders@ontario.ca
