I agree with comments from Ontario Nature regarding this proposal. I would like to add a few points regarding consultation and public participation as it relates to this proposal.
On October 30, 2025, Bill 56, Building a More Competitive Economy Act, 2025 received third reading in the legislature prior to November 10, 2025 which is when comments were due for this notice. This proposal was posted on September 26, 2025. This is less than 30 days. Section 15(1) of the environmental Bill of Rights says:
"If a minister considers that a proposal under consideration in his or her ministry for a policy or Act could, if implemented, have a significant effect on the environment, and the minister considers that the public should have an opportunity to comment on the proposal before implementation, the minister shall do everything in his or her power to give notice of the proposal to the public at least thirty days before the proposal is implemented."
In addition section 35 (1) says:
"A minister who gives notice of a proposal under section 15, 16 or 22 shall take every reasonable step to ensure that all comments relevant to the proposal that are received as part of the public participation process described in the notice of the proposal are considered when decisions about the proposal are made in the ministry."
Its evident that comments were not considered under the EBR as bill 56 did not go to committee nor was there 30 days.
This means that the Government of Ontario violated the Ontario Bill of Rights and there should be a review of this legislation.
