It seems the Community Benefit Strategy is focused on parkland. One of the primary concerns for many municipalities is providing affordable housing and I think may will be looking forward to using the Community Benefit Charge for affordable housing. What affordable housing items would be required in the Strategy and/or will a separate Affordable Housing Strategy be required to implement the CBC for affordable housing? There seems to be little direction in terms of affordable housing content? Also for the purposes of the CBC how will affordable housing be defined?
Can the regulation state that the appraised value for determining the value of the land for cash payment specifically state that the value must be determined by an independent appraisal completed by a certified appraiser. Many developers attempt to wiggle out of this or request to use their purchase price as the land valuation which could have taken place a significant time (years) before the day before the day a permit is issued. Municipalities can certainly adopt this requirement but it would have more teeth if it could somehow be right in the regulation.
