Please consider modifying/deleting this regulation. As it stands now, it is my understanding that testing/reporting must be carried out when transferring soil from one property to another. This potentially means testing and reporting within the same plan of subdivision where lots and blocks may be owned by different builders.
In green field developments, soil contamination is extremely rare, and anything deleterious is noted by our geotechnical engineers during bulk earthworks and/or sewer and watermain construction. We all have subdivision agreement clauses which provide some level of assurance that deleterious materials are handled and disposed of properly.
