I am very happy that the Ministry is trying to clarify how the Mining Act can be interpreted with respect to hobby mineral collecting in Ontario. Hobby mineral collecting is a great way for Ontarians to enjoy the great outdoors, to do things as a family or on our own outdoors, and to learn about Ontario's geology, and mineral resources. It is especially important that children be encouraged to enjoy this pursuit since some aspects of geology are part of the school curriculum, and some young people may become inspired to pursue careers in resource-based sectors and studies.

In my opinion, the Guide puts greater restrictions on hobby mineral collecting than are faced by people enjoying other aspects of outdoor recreation. For example, people who enjoy fishing are not required to obtain permits, licenses or permissions to fish at any time if the people fishing are less than 18 years of age, 65 years or older, a military veteran, or a disabled person. Also, everyone can fish without a license (without permission) in Ontario on 4 designated open fishing days throughout the year. More specifically related to mining claims, hikers and berry pickers are not required to seek permission from claim holders to pursue their activities on claims. Just as the provincial government provides special exemptions to encourage or facilitate fishing, the province, through the Guide, should strive to encourage or facilitate hobby mineral collecting by making the requirements for hobby mineral collecting less onerous. The Hobby Collecting Guide should exempt hobby mineral collectors from seeking permission from claim holders, providing the collectors are following the rules outlined in the Guide.
