My comment is concerning the following section of the draft regulation:
OBD system indicates malfunction
2. No person shall operate or cause or permit the operation of a motor vehicle if a malfunction indicator light of an OBD system is illuminated and the OBD system has an active emission-related DTC.
The Ministry of Transportation or police (whomever is enforcing this section) must have the appropriate methods or tools to test if a vehicle has an emissions related problem - in the case of the malfunction indicator light (MIL) being illuminated. There are a number of non-emissions reasons why the MIL would be illuminated such as: transmission, electronic shifter, drivetrain control module, ABS problems just to name a few.
Just because the MIL is on, doesn't necessary mean its a result of an emissions related issue. Should a motorist be pulled over by the appropriate authorities and the MIL is on, the authorities must have the appropriate tools to test and ensure the reason the MIL is on, is because of an emissions related concern.
My final comment is a suggestion that the Ministry publish the new regulations in a plain language document - either online, in a pamphlet or both - so everyone concerned (motorists and vehicle repair shops) can easily understand the new regulations, their responsibilities, new fines, etc.
