A Notice amending Environmental Compliance Approval (ECA) No. 7435-BW4KJM was issued to Evolution Mining Gold Operations Ltd. for industrial sewage works servicing the Red Lake Operations located in Balmertown, Municipality of Red Lake, District of Kenora, Ontario.

The proposal described in Evolution Mining Gold Operations Ltd.'s application dated February 28, 2024 and revised on July 8, 2025 to amend the ECA No. 7435-BW4KJM is for the following activities:

  1. Deposit of Campbell Mill tailings into the Red Lake Tailings Storage Facility (tailings management area) to facilitate closure of the Campbell Tailings Storage Facility.
  2. Upgrades to the mine wastewater treatment plant to handle arsenic, heavy metals and ammonia.

This approval amendment notice approves part of the application to amend ECA No.7435-BW4KJMM by approving the construction of the following:

  1. A Tailings Slurry Transference Pipeline, from the adjacent Campbell Mill to the Tailings Area #1 of Red Lake Tailing Management Area.
  2. North Saddle Dam to complete the perimeter of the Tailings Area #1 to the approved of crest elevation 378 metres; and
  3. Upgrades of wastewater treatment plant including retrofitting existing Actiflo treatment system to a metal precipitation reactor treatment system, and the addition of a new Actiflo treatment system.

The Director has determined that it is necessary for environmental protection purposes to approve the above-listed construction activities as these are time-critical activities that need to be constructed before prohibitive winter weather conditions set in and to ensure environmental protection. The ECA includes a condition prohibiting the operation of the Tailings Slurry Transference Pipeline or the upgraded mine wastewater treatment plant upon completion of construction except for testing purposes.

The Director has also posted for consultation a related instrument proposal for the operation of the works and associated conditions including conditions for monitoring, reporting, assessment, and effluent objectives and compliance limits. If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is for an amendment to Environmental Compliance Approval No. 7435-BW4KJM issued to Evolution Mining Gold Operations Ltd. for industrial sewage works servicing the Red Lake Operations, located at 15 Eric Radford Way, Balmertown, Municipality of Red Lake, District of Kenora, Ontario.

The company is proposing the following changes to Environmental Compliance Approval No. 7435-BW4KJM:

  1. Deposition of Campbell Mill tailings into the Red Lake Tailings Storage Facility (TSF) to facilitate closure of the Campbell Tailings Storage Facility.
  2. An extension to the east of the Red Lake TSF to support the current and expected future tailings storage and water management requirements to 2042.
  3. Upgrades to the water treatment plant to handle arsenic, heavy metals and ammonia.
  4. Establishment of a temporary mobile arsenic treatment plant during the upgrades to the water treatment plant.
  5. Storage of sludge from the Bateman Treatment Plant at the Red Lake TSF sludge ponds.
