Effects of consultation

Below is a summary of the comment we received and our response:

1. Green infrastructure should be included in the regulation

Comment: The stakeholder requested that green infrastructure be defined within the regulation and included as a mandatory requirement of municipal asset management plans and policies.

Response: O. Reg. 588/17: Asset Management Planning for Municipal Infrastructure requires that municipalities include a commitment to consider climate change and its associated impacts on their infrastructure as part of their Strategic Asset Management Policy.

Municipalities are also required to prepare, by July 1, 2021, an asset management plan that addresses all of their municipal infrastructure assets, including  ‘green infrastructure assets’ (as defined under the regulation), that are directly owned by the municipality or included on the consolidated financial statements of the municipality, with the exception of infrastructure assets that are managed by a joint municipal water board.

In addition to this consultation, we also received 1600 comments through nine regional in-person sessions held in summer 2016.

This notice was posted using the Policy format as the intent was to give the public an opportunity to provide online and written input on what content should be included in any proposed regulation, and how it could help advance municipal asset management planning across Ontario.

Description of policy

As more infrastructure funding becomes available, asset management plans to prioritize investments will be critical.

While almost all municipalities in Ontario have an asset management plan, significant differences remain in the completeness, level of detail, and methodology and assumptions used to develop these plans.

The Infrastructure for Jobs and Prosperity Act, 2015, was proclaimed on May 1, 2016 and includes an authority for the province to regulate municipal asset management planning. The province is consulting with the municipal sector and the public on what this regulation could look like.

The Ministry of Infrastructure has posted an online discussion paper seeking advice on what content should be included in any proposed regulation, and how it could help advance municipal asset management planning across Ontario.

Key themes explored in the discussion paper include:

  • The importance of asset management planning to ensure the long-term sustainability of infrastructure assets;
  • Understanding and accommodating the differences among municipalities throughout the province;
  • Integrating asset management planning with other municipal and provincial plans and policies; and
  • Optimizing investments to achieve proposed levels of service, while maintaining assets at the lowest lifecycle cost.

In posting this information on the Environmental Registry, the Ministry of Infrastructure recognizes that:

  • Good infrastructure planning incorporates environmental sustainability;
  • Infrastructure is increasingly seen as a tool to address environmental concerns such as water quality, green space, urban forest cover, air quality, and climate change mitigation; and
  • Environmental sustainability principles and climate change adaptation are essential considerations in planning for the long-term sustainability of infrastructure assets.

Purpose of policy

To seek input on content of any proposed municipal asset management planning regulation under the Infrastructure for Jobs and Prosperity Act, 2015.

Public consultation

This proposal was posted for a 30 day public review and comment period starting July 19, 2016. Comments were to be received by August 18, 2016.

All comments received during the comment period are being considered as part of the decision-making process by the Ministry.
