The ministry issued an Environmental Compliance Approval to Lafarge Canada Inc. for the establishment of sewage works for the collection, transmission, treatment and disposal of up to 12,184 liters per minute of water (including precipitation, stormwater runoff, snowmelt and groundwater) accumulating within the confines of the existing extraction area of the McAdoo Quarry located in the City of Kingston.

The approved sewage works consists of a dewatering sump housing an appropriately sized pumping arrangement with a discharge rate not to exceed 12,184 liters per minute, discharging via:

  • an existing on-site drainage ditch located at the west boundary of the quarry site
  • an existing drainage ditch located in the low lying valley along the escarpment of Tuttles Hill
  • an existing eastern roadside ditch located along Perth Road to the Little Cataraqui Creek

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

    • a statement about whether you are a resident in Ontario

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Proposal details

This proposal is for a new Environmental Compliance Approval (Industrial Sewage) to be issued to Lafarge Canada Inc. for the establishment of sewage works. The new sewage works is for the collection, transmission, treatment and disposal of industrial process wastewater from McAdoo Quarry located on lands legally described as Lots 26, 27 and 28, Concession 4, in the City of Kingston, Ontario.

The new sewage works will control the quantity discharging into a roadside ditch to North and West towards Little Creek, and ultimately into the Cataraqui Region Watershed.
