Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Bulletin details
The lands subject to this amendment are municipally known as 3600 Westney Road, Hamlet of Greenwood, in the City of Pickering and located on the southwest corner of Westney Road and Concession Road 6. The subject lands are legally described as Part of Lots 10 & 11, Concession 5, and Part of the Road Allowance Between Lots 10 & 11; shown as Parts 1, 2, and 3 on the Reference Plan 40R-5283. A location map is attached for reference.
The subject lands are identified within the Minister's Zoning Order, filed as Ontario Regulation 102/72, which was enacted in 1972 to protect lands for the future Pickering Airport. The Zoning Order generally restricts land uses to agricultural uses and accessory uses, including a single dwelling that is used in connection with an agricultural operation.
The effect of the amendment would be to permit a new single dwelling and accessory uses on the vacant portion of the subject lands. The purpose of the amendment is to facilitate the severance of the lands for residential uses.>
