Bill 276 (Supporting Recovery and Competitiveness Act, 2021) received Royal Assent on June 3, 2021
Why consultation isn't required
The proposed Supporting Recovery and Competitiveness Act, 2021 is a package of legislative changes led by the Ministry of Economic Development, Job Creation and Trade (MEDJCT). However, MEDJCT does not have responsibility for any legislative amendments in the package that would have a significant effect on the environment.
Ministries responsible for legislation in this package are undertaking public consultation, as required under the Environmental Bill of Rights (EBR) for amendments that could, if implemented, have a significant effect on the environment.
As the proposed amendments within the bill are from 12 ministries, the ministries are responsible to evaluate their individual proposed legislative amendments against the requirements from the EBR. Where there is potential environmental impact, the individual ministry has completed a proposal notice to which it has been posted on the environmental registry.

There are proposals in this Bill that do not have significant impact on the environment but may impact businesses. Opportunities to comment on these additional proposals are available on Ontario’s Regulatory Registry.
Bulletin details
The amendments contained in the proposed Supporting Recovery and Competitiveness Act, 2021 will focus on:
- supporting businesses to recover and rebuild rather than permanently shut down
- increasing flexibility for businesses to invest in creative revenue opportunities
- increasing competitiveness to attract new foreign direct investment in the long term, while keeping Ontario-grown companies in Ontario
- supporting job-creation
- supporting more cost-effective ways to do business and live in Ontario, without compromising safeguards that protect health & well-being, public safety and the environment
- increasing economic activity

Summary of amendment(s):
We are proposing to repeal legislative provisions that promote and prioritize the development of renewable energy. Ontario has built a clean energy supply, going forward, Ontario will ensure value for ratepayers by allowing all resources to compete to meet system needs.

Act: Mining Act
Title of notice: Proposal to Establish a Public Registry for Licences of Occupation
Under the Environmental Bill of Rights, this proposal does not require consultation as there are no anticipated potentially significant environmental impacts with the proposed amendment. However, given the environmental significance of the Mining Act, the ministry is voluntarily posting this notice for comment.
Summary of amendment(s):
We want to amend the Mining Act to establish a public registry for licences of occupation, so the public can more easily access the Ministry’s information. The registry would be accessible through the Mining Lands Administration System (MLAS).

Act: Mining Act
Title of notice: Amendment of the Mining Act to enable a more streamlined approach to authorizing the sale of end product from bulk samples
Summary of amendment(s):
We want to amend the Mining Act to enable regulations to establish a “permit by rule” model, allowing claim holders to sell the end product of a bulk sample, and retain proceeds, provided that certain conditions are met. There are no anticipated environmental impacts associated with this proposal.

Title of notice: Proposed changes to certain land division provisions in the Planning Act
Summary of amendment(s):
The proposed amendments include technical, administrative, procedural and policy changes to provisions in sections 50, 51, 53, 54, 55 and 57 of the Planning Act related to control of the division of land (subdivision control, plans of subdivision, consents and validations), as well as other housekeeping or consequential changes to the Act.
