Decision summary
The recently passed Moving Ontarians More Safely Act, 2021 (MOMS Act) will help protect people and families by targeting stunt driving and unsafe, high-risk driving as well as to protect vulnerable road users, such as pedestrians and highway workers, improve commercial vehicle safety, and strengthen oversight of the towing and storage sectors.
Decision details
The legislation was drafted to reflect transportation data and trends and after much consultation with safety organizations, municipalities, enforcement agencies and other partners with knowledge and expertise of the different areas addressed by the legislation. The ministry reviewed all comments received on both the Environmental Registry and Regulatory Registry postings. After careful consideration, no changes were made to the initially proposed legislation.
Effects of consultation
Two comments were received on the Environmental Registry posting but neither of them was related to elements of the MOMS Act that were considered to potentially have environmental impacts. The comments submitted did not raise environmental concerns.
However, all comments received in response to the Environmental Registry and Regulatory Registry postings were reviewed by the ministry's subject matter experts and considered in making final decisions.
Where applicable, comments received in response to the Environmental Registry and Regulatory Registry postings will be further considered in the development of regulations.
For example, although changes were not made to the proposed legislative elements of the Towing and Storage Safety and Enforcement Act, 2021 (TSSEA), the legislation grants the government authority to develop regulation to support the implementation of the Act. The Ministry of Transportation is continuing consultations with the industry and stakeholders to support the development of regulations.

Proposal details
The proposal sets out initiatives that, if passed, would help keep Ontario’s roads among the safest in North America through enhancements to Ontario’s existing stunt driving law and new measures to address vulnerable road user safety and commercial vehicle safety.
These proposals could, if passed, have an impact in curbing aggressive and high-risk driving behaviour that impacts all road users, including children using school buses, workers on or near highways and street car passengers.
Below is additional information about proposed elements with environmental impacts.
Vulnerable Road Users

Introduce street car camera evidence framework – This proposal would establish a vehicle-based infraction for passing a street car illegally, allowing a charge to be laid on the basis of photographic evidence. The proposal would eliminate the need for a witness to attend court to testify to the validity of the evidence. This proposal would provide swift and certain penalties for illegally passing a street car in order to improve driver behaviour around vulnerable road users and improve vulnerable road user safety. The safety outcomes from this proposal may have a positive impact on public transit ridership and expand safe and sustainable mobility options for Ontarians.
- Redefine e-Bikes – This proposal would update the definition of e-bikes in response to the repeal of the federal definition on February 19, 2021, and only permit traditional bicycle style e-bikes and add two sub-classes of e-bikes, which will capture moped and motorcycle styles separately. This proposal supports MTO in delivering key priorities to increase transit ridership through:
- assisting with first- and last-mile connections, supporting greenhouse gas reductions, as the proposal is anticipated to encourage the use of e-bikes in place of motor vehicles such as cars, and supporting climate change initiatives by increasing e-bike transit ridership as smaller e-bikes may be able to be set on transit bike racks
- promote road safety by responding to safety concerns from municipalities and enforcement regarding larger e-bikes interacting with vulnerable road users, including pedestrians.
