Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act regulates the use of land and the erection, location and use of any building or structure on the land
Ontario Regulation 768/21 permits approximately 25 tiny homes that are proposed for military veterans experiencing homelessness on a 1.5 acre parcel of land.
Ontario Regulation 768/21 applies to lands known as the Kingston Provincial Campus (752 King Street West) and are legally described as Part of Block 60 on Registered Plan No. 54, City of Kingston, County of Frontenac. For illustrative purposes, the subject lands are shown in a location map, the link to which is set out below.
Pursuant to subsection 47(4) of the Planning Act and except for the purposes of section 24, the Minister deemed Ontario Regulation 768/21 to be and to always have been a by-law passed by the Council of the City of Kingston.
