Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. (Ontario Regulation) 335/22 and O. Reg. 336/22 provides permissions for a range and mix of residential, commercial and institutional uses to support the development of a Transit-Oriented Community. Specifically, O. Reg. 335/22 provides for a maximum gross floor area of 95,381 square metres. O. Reg. 336/22 provides for a maximum gross floor area of 91,561 square metres.
O. Reg. (Ontario Regulation) 335/22 applies to lands municipally known as 250 - 260 Front Street East in the City of Toronto.
O. Reg. (Ontario Regulation) 336/22 applies to lands municipally known as 265 - 271 Front Street East in the City of Toronto.
The lands subject to O. Reg. 335/22 are described as:
lands in the City of Toronto, in the Province of Ontario, being lands described as,
(a) part of Block R (Small’s Lot), and part of Lands patented to William Halton, Town of York Plan, designated as Part 1 on Expropriation Plan AT5740720, and further identified by Property Identification Number 21091-0018 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80);
(b) part of Lands patented to William Halton, Town of York Plan, designated as Part 1 on Expropriation Plan AT5740738, and further identified by Property Identification Number 21091-0267 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80); and;
(c) part of Block R (Small’s Lot), and part of Lands patented to William Halton, Town of York Plan, designated as Part 2 on Expropriation Plan AT5740738, and further identified by Property Identification Number 21091-0268 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80).

(b) part of Lot Old County Gaol, Town of York Plan, designated as Part 1 on Expropriation Plan AT5740805, and further identified by Property Identification Number 21092-0248 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80);
(c) part of Lot Old County Gaol, Town of York Plan, designated as Part 2 on Expropriation Plan AT5740805, and further identified by Property Identification Number 21092-0249 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80); and

Pursuant to subject 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. (Ontario Regulation) 335/22 and O. Reg. (Ontario Regulation) 336/22 to be and to always have been by-laws passed by the Council of the City of Toronto.
