The application for consent, 60-C-214694 is draft approved subject to conditions. The applicants have two years to satisfy conditions of draft approval, otherwise approval will lapse. Conditions include: a requirement for an undertaking from the person registering the documents agreeing to register the consolidations of the severed with the abutting property (PIN 42150-2090) once the land transfers have been registered; a letter from the Northwestern Health Unit that the severed and receiving parcels have been inspected by the Health Unit and that systems meet their requirements; that a letter is received from a sewage hauler confirming the disposal facility has sufficient reserve capacity to accept hauled sewage from the lots; and that an acknowledgement from the transferors and transferees that information attached regarding mining sites and assessment work have been read. The last date to appeal the decision in May 23, 2023.

Effects of consultation

Niisaachewan Anishinaabe Nation provided comments as a result of the ERO posting on October 25, 2022. Further discussions took place to determine potential adverse impacts to Aboriginal and Treaty rights. As this application is technical in nature, does not create any new development rights, and is consistent with the Provincial Policy Statement, the Ministry approved the application.

Proposal details

The purpose of this application for consent 60-C-214694 is to sever a triangular portion of land approximately 0.065 hectares from PIN 42150-2091, Lot 3 of Plan 228 and transfer to the abutting PIN 42150-2090, Lot 4 . The proposed severed lot is 0.065 hectares with no frontage, and 85 metres of depth. The proposed retained lot would be 1.47 hectares with 80 metres of frontage and 154 metres of depth. The lands receiving the addition are 0.89 hectares with 58.91 metres of frontage and 179.8 metres of depth. The effect of this application is to adjust the boundary between abutting properties to accommodate encroaching resource-based recreational structures. The application will ensure the buildings associated with the owners of PIN 42150-2090 are within the boundaries of the property. The retained lot, and the lot receiving the severed lands are each used for cottaging and contain resource-based recreational dwellings serviced by septic and water drawn from Lake of the Woods.
