A decision was made on October 9, 2024 to approve, with 14 modifications, Official Plan Amendment 38 to the Town of St. Marys Official Plan adopted pursuant to sections 17 and 26 of the Planning Act by By-law 36-2022. Notice of this Decision was issued on October 9, 2024 to the Town of St. Marys.
The adopted Official Plan Amendment was reviewed for consistency with provincial policies and regard for matters of provincial interest set out in the Planning Act.
Fourteen modifications to the Official Plan Amendment have been made to address policies regarding cultural heritage and archeology, land use compatibility, human-made hazards, roles and responsibilities of planning authorities, Special Policy Area (flood hazard), wildland fire hazard, prime agricultural areas, reserve system capacity, settlement area boundary adjustments, and Indigenous engagement, among other matters.
Town of St. Marys Official Plan Amendment 38 amends policy regarding cultural and natural heritage conservation, residential, commercial, and industrial land uses, land division, source water protection, and complete applications. Settlement area boundary expansions, comprising 31 hectares of land, have been made to accommodate the anticipated population growth (residential land needs) of the Town to the year 2044.
Official Plan Amendment 38 applies to all lands within the Town of St. Marys.
Effects of consultation
Two comments were received from Indigenous communities. Two modifications were made to require engagement with Indigenous communities on land use planning matters and to clarify the responsibility of the Town in engaging with Indigenous communities on cultural heritage matters.

Appeals are not allowed
Pursuant to subsection 17(36.5) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding Official Plan Amendment 38, adopted in accordance with sections 17 and 26 of the Planning Act, is final and not subject to appeal.

On April 12, 2022, the Town of St. Marys adopted Official Plan Amendment 38 by By-law 36-2022. The official plan amendment is now before the Minister of Municipal Affairs and Housing for a decision in accordance with Sections 17 and 26 of the Planning Act.
Official Plan Amendment 38 proposes to implement the policies of the Provincial Policy Statement, as well as the provisions of the Planning Act and Clean Water Act, across the Town. Official Plan Amendment 38 proposes to amend policy regarding cultural and natural heritage conservation, residential, commercial, and industrial land uses, the division of land, source water protection, and complete applications, as well as mapping changes. Settlement area boundary expansions are proposed to accommodate the anticipated land needs of the Town.
If approved, the policy and mapping changes of Official Plan Amendment 38 would apply across the Town.
