Decision summary

A decision was made to revoke a Minister’s Zoning Order (MZO) that applied to lands in the City of Pickering, filed as Ontario Regulation 154/03.

Decision details

On December 14, 2022, the Minister filed Ontario Regulation 566/22, which revoked Ontario Regulation 154/03. Ontario Regulation 154/03 applied to approximately 2000 hectares (4950 acres), generally located east of Scarborough Pickering Townline, north of the CN rail line, west of West Duffins Creek and south of Highway 7.

A Zoning Order regulates the use of land and the erection, location and use of structures on the land. Ontario Regulation 154/03 provided direction on the land uses and associated development standards permitted within the Subject Lands.

Section 47 of the Planning Act allows the Minister of Municipal Affairs and Housing to amend or revoke a MZO. Notice must be given prior to a decision being made regarding the revocation of a MZO, as required under subsection 47(9) of the Act.

The Ministry of Municipal Affairs and Housing published notice through the Environmental Registry of Ontario, inviting comments from the public for a period of 30 days on the proposal to revoke the MZO. Comments were received from the public and were considered in making the decision to revoke the MZO.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Proposal details

Take notice that the Minister of Municipal Affairs and Housing, under subsection 47(8) of the Planning Act, proposes to revoke a Zoning Order in the City of Pickering, Regional Municipality of Durham, filed as Ontario Regulation 154/03.

Ontario Regulation 154/03 applies to the lands identified on Reference Map No. 210. The lands subject to the Zoning Order are approximately 2000 hectares (4950 acres) in size, and generally located east of Scarborough Pickering Townline, north of the CN rail line, west of West Duffins Creek and south of Highway 7.
