Decision details
The application for consent, 60-C-245075 is draft approved subject to conditions. The applicants have two years to satisfy standard conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before May 19, 2025.
Conditions include:
- That the application to transfer noted in condition 2 shall identify the property and ownership which the easement favours and the purpose of the easement.
- That the easement be registered and shown on the title for PIN 42151-0587 in favour of PIN 42151-0586.
- That prior to final approval, the Ministry is to be provided by the applicant with written verification from the Ministry of Transportation (MTO) that entrance permit will be made available. See note #3 for additional information.
- That prior to final approval, the Ministry is to be provided a written document from Ontario Land Surveyor to confirm that no buildings, structure, or utilities are present within the identified corridor.
