We have amended the Environmental Assessment Act to remove the requirement for a comprehensive environmental assessment for the Eagle’s Nest mine project.
Decision details
The Ontario government has made legislative changes that remove the requirement for a comprehensive environmental assessment for the proposed Eagle’s Nest mine project. The voluntary agreement has been terminated and the terms of reference approval revoked.
These changes have been made through amendments to the Environmental Assessment Act contained in section 1 of Schedule 3 of Bill 5, Protect Ontario by Unleashing our Economy Act, 2025, S.O. 2025, c. 4 - Bill 5 | ontario.ca. Bill 5 received Royal Assent on June 5, 2025, bringing the amendments into effect.
The decision reflects significant changes to the project scope since the terms of reference was approved in 2015. The proposed mine will continue to be subject to environmental oversight, including public consultation requirements and obligations to consult with potentially affected Indigenous communities.

There are no direct compliance costs or new administrative burdens associated with the amendment.
Effects of consultation
We received a total of 115 comments:
- 105 comments through the Registry
- 10 direct emails
Input was also sought directly from Indigenous communities that received notification about the approval of the terms of reference in 2015.
Most comments expressed concern about Bill 5 in general, while some expressed specific concerns about removing the comprehensive environmental assessment requirements for the proposed Eagle’s Nest mine. Concerns were raised about the potential effects of the project, as it is in an ecologically sensitive area.
All comments received on the proposal were considered. No changes were made to section 1 of Schedule 3 of the Bill. The following is a summary of the comments received on the proposal and how we considered them:
Concern that the proposal would present risks to ecosystems, biodiversity, peatlands and climate impacts, especially in the Ring of Fire region. Many suggested the proposal is weakening environmental assessments and environmental oversight.
Response: The Eagle’s Nest project scope has changed significantly over time and the approved terms of reference is no longer aligned with the project as currently proposed. The project will continue to have strong environmental oversight, including requirements to obtain any applicable environmental permissions.
Concern with the lack of consultation with Indigenous communities on the proposed mine, impacts to Aboriginal and Treaty rights and the need for consent before development proceeds.
Response: The proposed mine will continue to be subject to provincial permissions, including any consultation opportunities that come with those processes.. Ontario will continue to meet its duty to consult obligations to Indigenous communities and respect Aboriginal and Treaty rights, as recognized and affirmed by section 35 of the Constitution Act, 1982. Ontario is also committed to advancing economic reconciliation with First Nations partners.
Concern over the lack of transparency, rushed timelines, and reduced opportunities for public input on Bill 5.
Response: The proposal notice was open for 30 days until May 17, 2025. Input was also sought directly from Indigenous communities that received notification about the approval of the terms of reference in 2015. Ministry staff met with Indigenous communities upon request, and there were also opportunities to participate in the legislative process for the bill. Ontario is supporting a strong and independent critical minerals sector while maintaining important environmental protections. The mine will continue to be subject to environmental oversight through environmental permissions, including any consultation opportunities that come with those processes.

Proposed legislation
As a result of significant changes to the scope of the Eagle’s Nest mine project (the “Project”), the province is proposing to amend the Environmental Assessment Act to remove the current requirement that the Project undergo a comprehensive environmental assessment through the proposed Protecting Ontario by Unleashing Our Economy Act, 2025.
The Project is a proposed new underground metals mine in the area of Northern Ontario known as the Ring of Fire. The Eagle’s Nest mine project became subject to a comprehensive environmental assessment through an agreement signed by Noront Resources Inc. under the Environmental Assessment Act in 2011, sometimes called a “voluntary agreement”. The terms of reference for an environmental assessment was approved by the Minister of the Environment in 2015 with amendments.
The project scope has changed significantly since 2015 and the approved terms of reference is no longer aligned with the project as it is currently proposed.
If passed, the proposed legislation in relation to the Eagle’s Nest mine project would:
- terminate the outdated voluntary agreement
- revoke the terms of reference approval
- make other related amendments to the Environmental Assessment Act
The proposed mine would continue to be subject to environmental oversight through environmental permissions, including any related public consultation requirements and obligations to consult with potentially affected Indigenous communities.
Proposed project
Wyloo is seeking to develop the Eagle’s Nest Mine, a proposed new underground multi-mineral mine located in the Ring of Fire area near McFaulds Lake in northern Ontario, 530 km northeast of Thunder Bay.
The project involves the construction, operation, and closure of the mine and associated infrastructure.
Timelines
If the legislation is passed, it would come into effect on Royal Assent.
