Decision details
The Director has issued Order No. 1-1489998844 under sections 18, 43 and 182 of the Environmental Protection Act. The Order requires persons in charge, management or control of the undertaking at the Site to undertake actions to prevent or reduce the risk of a discharge of a contaminant into the natural environment from the undertaking or property; or to prevent, decrease or eliminate an adverse effect that may result from the presence or discharge of a contaminant in, on or under the property or adjacent properties.
This Director’s Order requires the Principal Orderees (Peterborough Concrete Floor Co. Ltd., R.E. Kemp Construction Limited, Brukel Construction Limited), collectively, jointly and severally, to undertake actions, which amongst others, include:
- retain an approved waste hauler to remove the waste stockpile located at 2026 Campbell Avenue and dispose of it at registered waste disposal site
- upon removal of the waste, any receipts or bills of lading must be sent to the Director by email
- retain a qualified person to conduct an environmental site assessment of 2036, 2033, 2029, 2026, 2025, 2019, and 2016 Campbell Avenue, to assess for any waste or environmental impacts located in or around the historical waste disposal site
- An assessment report be prepared and submitted to the Director for review by the ministry
The Director’s Order further requires that Keith David Jamieson and Thi Cam Van Tran, identified as the current property owners of 2026 Campbell Avenue, remove and transport the waste stockpile located at 2026 Campbell Avenue, Cavan-Monaghan, using an Approved Waste Management System and have the waste deposited at an Approved Waste Disposal Site(s), if Item No. 1 is not completed by the listed compliance date.
Effects of consultation
Public consultation on the proposal for this decision was provided for 45 days from August 5, 2025, to September 20, 2025. Two comments were received during the posting window via the ERO. The Director, after consultation with ministry legal counsel, made changes to the Order to reflect revised persons with responsibility of the Site.
The information below summarizes the public's comments and how the ministry considered and addressed them as part of our decision:
Two comments were received via the ERO on this proposal during the 45 days commenting period. The two comments are summarized as follows:
- A member of the public is supportive of the ministry’s approach to order the removal of the waste pile that has been visible for more than 3 years and is likely impacting neighboring property values.
- Brukel Construction requested to be removed from the Order and suggests the ministry focus on other historic landowners/operators and questioned why the current property owners of 2026 Campbell Avenue were not listed as Principal Orderees.
The comments were reviewed and, where appropriate, was considered in the ministry’s decision whether or not to proceed with the listed Orderees.

Proposal details
A historic non-hazardous waste site was discovered at 2026 Campbell Avenue, Township of Cavan Monaghan, in 2023 during exaction activities during the construction of a new house. The waste extends under the planned house foundation and is extensive in nature. The residential area is privately serviced and relies on the local groundwater supply for domestic and drinking water needs.
This site had not previously been identified as a waste disposal site by the Ministry, or Township, and did not have any records of the waste being present.
The director reasonably believes that the site could be potentially causing an adverse effect as defined by the Environmental Protection Act, to the natural environment.
This proposed Director’s Order will require the Principal Orderees (Peterborough concrete Flooring Company, R.E. Kemp Construction Limited, Brukel Construction Limited and Mijar Limited), collectively, jointly and severally, to undertake actions, which amongst others, include:
- retain an approved waste hauler to remove the waste pile located at 2026 Campbell Avenue and dispose at registered waste disposal site
- upon removal of the waste, any receipts or bills of lading must be sent to the director by email
- retain a Qualified Professional to conduct an environmental site assessment of 2036, 2033, 2029, 2026, 2025, 2019, and 2016 Campbell Avenue, to assess for any waste or environmental impacts located in or around the historical waste disposal site
- an assessment report will be prepared and submitted to the director for review by the Ministry's technical support staff
