On June 11 2026, the Minister of Infrastructure made Zoning Order 05-2026, for the Eastern Avenue Transit-Oriented Community (TOC) in the City of Toronto (Transit-Oriented Community Lands).
Decision details
A Minister’s Zoning Order (MZO), made pursuant to clause 47(1) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. Through Order in Council 589/2025 the Minister of Infrastructure may exercise the powers and perform the duties, functions and responsibilities of the Minister of Municipal Affairs and Housing under section 47 of the Planning Act in respect of transit-oriented community land designated under subsection 2 (1) of the Transit-Oriented Communities Act, 2020. Lands known municipally as 356 Eastern Avenue and 364 Eastern Avenue, on the Ontario Line, in the City of Toronto, were designated as a transit-oriented community through Order in Council 878/2025. The site is approximately 0.87 acres in size and is bound by Lewis Street to the west, a laneway to the north, Saulter Street and the Metrolinx rail corridor to the east, and Eastern Avenue to the south. The site is planned to have approximately 165 new homes and accommodate over 25 jobs. The site was previously occupied by a 5-storey self-storage facility and a small surface parking lot. The Minister of Infrastructure made Zoning Order 05-2026 on these lands which permits:
The Zoning Order includes exceptions to the requirements of the City of Toronto’s Zoning By-law including building height, setbacks, maximum lot coverage, density, dimensions of accessible parking, and any requirement for Inclusionary Zoning. This approach is designed to better reflect evolving market conditions and support the delivery of a transit-oriented community. The Ministry of Infrastructure sought public and stakeholder feedback to inform the decision by posting on the Environmental Registry of Ontario (ERO) for 30 days from September 19, 2025 to October 19, 2025. Bill 60, Fighting Delays, Building Faster Act, 2025 received Royal Assent on November 27, 2025, and as such this Order is not a provincial regulation and will not be filed with the Registrar of Regulations.

Effects of consultation
The Province undertook an engagement process for the Eastern Avenue TOC proposal, through Local Advisory Committee meetings, Virtual and In-Person Open House sessions, as well as through written surveys, and through the concluded ERO proposal notice.
Feedback was received throughout the engagement process on elements of the proposal and all comments received were taken into consideration prior to a decision being made.
Members of the public appreciated the project's moderate density, adherence to good planning principles, road connections, and respect for neighborhood character.
Members of the public expressed concerns that no affordable housing targets were identified.
Among the changes made in response to the feedback, the height of the building was increased to create space for 18 more new homes.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the Ministry is providing public notice of this request for a zoning order.
Proposal details
The Minister of Infrastructure is proposing to make a Minister’s Zoning Order at 356 Eastern Avenue and 364 Eastern Avenue, in the City of Toronto. Together, these lands are referred to as the Eastern Avenue Transit-Oriented Community (TOC) and have been designated as transit-oriented community lands under section 2 of the Transit Oriented Communities Act, 2020.
Pursuant to Order-in-Council 589/25 the Minister of Infrastructure shares authority, with the Minister of Municipal Affairs and Housing, to make Ministerial Zoning orders under s. 47 (1) (a) of the Planning Act for transit-oriented community lands.
The proposed Zoning Order will include exceptions to the requirements of the City of Toronto’s Zoning By-law including building height, setbacks, maximum lot coverage, dimensions of accessible parking, and any requirement for Inclusionary Zoning. This approach is designed to better reflect evolving market conditions and support the delivery of a transit-oriented community.
The Minister is also proposing to use enhanced authorities pursuant to clauses 47(4.3) (a) and (b) of the Planning Act to remove site plan approval and require the landowner enter into one or more agreements with the City of Toronto dealing with matters listed in subsection 47(4.4) of the Act on the subject lands.
