Decision details

The ECA Notice allows Clean Harbors to construct a contingency process water pond located on the north west side of the facility, adjacent to Cell 18.

  • This pond is to be constructed outside of the landfill footprint, on virgin land
  • The pond will be constructed in two phases. Phase 1 will have a total storage capacity of 56,000 metres cubed and Phase 2 will allow the expanded pond to have a total storage capacity of 87,000 metres cubed
  • The company will initially construct the pond as Phase 1, and then construct Phase 2 if determined to be operationally required

The pond is to be used as contingency pond and be limited to emergency overflow situations during extreme weather events that exceed the capacity of the previously existing Process Water Pond system, or as additional capacity storage of Process Water during extended incinerator maintenance shutdown events.

No negative environmental impacts are expected from the construction of this pond.

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

Proposal details

Clean Harbors operates an integrated hazardous waste management facility located on Lot 9 and part of Lot 8 in the Township of St. Clair. A key operational factor at the site is the appropriate management and collection of surface water at the site. One approach to managing surface water is to collect and manage water that falls onto processing areas into process water storage ponds. Currently, Clean Harbors has five existing process ponds around the site to manage process water. Due to operational needs, an additional pond is required for future weather events.

Clean Harbors is proposing to construct a contingency process water pond located on the north west side of the facility, adjacent to Cell 18. The proposed pond would be constructed outside of the landfill footprint, on virgin land.

The pond will be constructed of compacted clay. The pond walls will have a top elevation of approximately 207.3 metres above sea level and the pond base will be at 202.0 metres above sea level. The company is proposing to construct the pond in two phases. The pond constructed in phase one would have a total storage capacity of 56,000 cubic metres. The addition of the phase one pond will double the current storage capacity for process water at the facility. In phase two the pond would be expanded to have a total storage capacity of 87,000 cubic metres.

The new Process Pond will be an as-built pond as per the other process water ponds. The general layout of the pond and typical cross section of the ponds is provided in the supplemental information. The company would construct the pond as per phase one, and then construct phase two if determined to be operationally required.
