Proposal summary
The Minister of Municipal Affairs and Housing received a request to make a Minister’s Zoning Order in the Township of Clearview. The Ministry is seeking input on whether this request should be considered and any additional information that may help inform the Minister’s decision-making.
Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the Ministry is providing public notice of this request for consultation.
Proposal details
An MZO, made pursuant to section 47 of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land, and prevails over the existing municipal zoning by-law to the extent there is any conflict.
The Ministry of Municipal Affairs and Housing is consulting on a request from MHBC on behalf of 1906999 Ontario Ltd. and Clearview Aviation Business Park Inc. for a Minister’s Zoning Order (MZO) to facilitate development on the lands known as the Clearview Aviation Business Park at 6833 33/34 Nottawasaga Sideroad and 6630 30/31 Nottawasaga Sideroad & Part Lot 32, Concession 5 in the Township of Clearview.
The subject lands are approximately 107 hectares and are located immediately east of the Collingwood Regional Airport. The subject lands currently contain agricultural uses.
The subject lands are designated:
- Agricultural and subject to The Special Development Area – Collingwood Airport overlay policies in the County of Simcoe Official Plan; and
- Airport-Related Employment in the Township of Clearview Official Plan and are zoned to permit a range of aviation related employment and commercial uses.
If made, the requested MZO would expand the range of permitted uses on the subject lands. Specifically, the MZO would permit the following uses in addition to those currently permitted in the Airport Industrial Exception No. 2 (MA-2) Zone, Airport Industrial Exception No. 3 (MA-3) Zone and Airport Industrial Exception No. 4 (MA-4) Zone under Township of Clearview Zoning By-law 06-54:
- Motor vehicle sales, service, display and rental
- Recreational vehicle sales and service establishments
- Marine sales establishments
- Equipment sales and rental establishments
- Manufacturing, processing, repairing, fabricating and assembly operations
- Motor vehicle repair establishments
- Motor vehicle body shops
- Warehousing
- Cartage terminals and warehousing
- Light equipment sales and rental establishments
- Research establishments, including laboratories
- Data processing centres
- Business, professional and administrative offices
- Fueling stations
- Outdoor storage, and
- Truck, transport and shipping terminals
This MZO request also seeks exemption from the application of policy statements, provincial plans and official plans to downstream approvals pursuant to subsection 47(4.0.1) of the Planning Act.
The Township of Clearview previously submitted a request for Community Infrastructure and Housing Accelerator (CIHA) order in March 2024 regarding a similar proposal for the subject lands. The CIHA request was considered as an MZO request and posted on the ERO (#019-8614) for public consultation. That request was declined, and the Township was notified of the decision on January 10, 2025. A letter of support from the mayor of Clearview was submitted with this new MZO request, which confirms the Township’s continued support for the proposal.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision. In particular, any potential environmental risks, financial impacts on the municipality or implications for other approved developments and how these can be mitigated.
This proposal for an MZO is posted for consultation as a “regulation” notice type due to webform template formatting limitations. However, as a result of amendments to section 47 of the Planning Act by Bill 60, Fighting Delays, Building Faster Act, 2025, which received Royal Assent on November 27, 2025, the proposed MZO, if made, will not be a regulation and will not be filed with the Registrar of Regulations.
