Decision details

Aggregate Resources Act (ARA) licence No. 625573 was issued to Arbour Farms Limited on October 5, 2021, subject to conditions specified on Schedule A (Prescribed Conditions) and B.

The licensed area is 41.68 hectares in size and allows the operation of a pit below the water table. The tonnage condition specifies a maximum of 500,000 tonnes of aggregate to be removed from the site in any calendar year.

Effects of consultation

One (1) comment was received in response to the Environmental Registry notice, however it was not specific to this application.  Eighty-five (85) letters of objection were received in response to the ARA consultation process. 

The main concerns of the objections included:

  • truck traffic
  • road safety
  • use of Airport Road as a haul route 

The applicant worked to address the objections by providing additional information and revising the site plan.

There were twenty-three (23) outstanding objections at the end of the ARA process. The application was referred to the OLT for a decision. A hearing was held January 21, 2019 and November 20, 2020. On April 8, 2021 the OLT directed the minister to issue the licence (OLT Case no: PL150119).

The proposal notice for this application was updated on January 26, 2016 to advise the public that this application under the Aggregate Resources Act has been referred by the Ministry of Natural Resources and Forestry to the Ontario Municipal Board for a hearing.

Description of instrument

Arbour Farms Limited have applied for a Class “A”, Category 1 licence (Pit Below Water) to excavate aggregate from a pit of 41.68 hectares in size. This application is for a new pit. The annual tonnage condition applied for is 500,000 tonnes per calendar year.

Comments received through ER should not be construed as an objection under the Aggregate Resources Act in accordance with section 4.0 – Notification and Consultation Standards of the Provincial Standards 1.0 under the ARA. To be considered as a formal objector, individuals need to contact the MNR person specified on this notice to determine how to submit an objection.

As specified in the Aggregate Resources Act, written notice concerning this application was delivered to landowners within 120 metres of the proposed licenced boundary; an information sign, giving notice to the public of this application was erected at the proposed site; and a Notice of Application appeared in the local papers, the Creemore Echo (circulating January 4th, 2013) and Alliston Herald and the Shelburne Free Press on January 10, 2013. A public information session will be held on February 7, 2013 between 4 pm and 7 pm at the Township of Mulmur Town Hall.

The application for this proposal is being circulated within the MNR Midhurst District office. Additionally, notification of this application will be forwarded to the Nottawasaga Valley Conservation Authority, the Ministry of the Environment, The Township of Mulmur and the County of Dufferin
