An amendment to the Niagara Escarpment Plan as been approved to reduce the number of permitted units from eight to five on a draft plan of condominium for the property located in the Municipality of Grey Highlands, County of Grey.
Decision details
Niagara Escarpment Plan Amendment PG 203 was approved by the Minister on April 11, 2017. The Amendment changes the special policies applicable to the subject lands to allow for approval of a five-unit Plan of Condominium instead of the eight-unit plan of condominium allowed for under previous Niagara Escarpment Plan policies. As a result, the Niagara Escarpment Plan is amended as follows:
1. Part 1.3 Escarpment Natural Area is amended by deleting permitted use #15 in its entirety and replacing it with the following new permitted use:
15. Those uses as set out in the in the Special Provisions for the Duncan Lake condominium lands as set out in Part 2.2.22 of this Plan.
2. Part 1.3 Escarpment Natural Area is amended by deleting new lot policy #5 in its entirety and replacing it with the following new lot policy:
5. Except as provided for in the Special Provisions for the Duncan Lake condominium lands as set out in Part 2.2.22 of the Plan, no new lots shall be permitted.
3. Part 1.4 Escarpment Protection Area is amended by deleting permitted use #21 in its entirety and replacing it with the following new permitted use:
21. Those uses as set out in the Special Provisions for the Duncan Lake f) Except for landscaping and vegetation plantings, no site alterations, buildings, structures or other accessory or incidental facilities, including sewage systems shall be placed or constructed within 30 metres (98 feet) of the high water mark of Duncan Lake or the banks of any watercourse on the Duncan Lake condominium lands. g) No alterations to the shoreline of the Duncan Lake shall be permitted with the exception of shoreline plantings. h) Activities related to forest, wildlife and fisheries management, archaeology and recreation may be considered on the Duncan Lake condominium lands, subject to the applicable policies of the Niagara Escarpment Plan.
Effects of consultation
No comments were received in response to the Environmental Registry notice. However, as a result of the notification requirements under the Niagara Escarpment Planning and Development Act, comments were received from the following government agencies: County of Grey, Grey Sauble Conservation Authority, the Ministry of Environment and Climate Change, and the Ministry of Tourism, Culture and Sport. There were no objections to the amendment. The Conservation Authority recommended a minimum 30-metre development setback from the lake and riparian wetland feature, and that erosion and sediments control measures be undertaken during development. This recommendation was included in subsequent development approvals.
No Appeal exists on the ministry's decision.

Description of policy
An amendment to the Niagara Escarpment Plan (NEP) is required to reduce the number of permitted units from eight to five on a draft plan of condominium for the property located at Lots 7, 8 and West 1/2 Lot 9, Concession 2, Municipality of Grey Highlands, County of Grey.
Up to eight condominium units were previously permitted as part of a family vacation compound, but the technical studies undertaken as part of the draft Plan of Condominium application process revealed concerns about impacts on natural heritage features and functions from the proposed eight units.
To address these environmental concerns, the landowner has agreed to reduce the total number of condominium units from eight to five, to limit development to the least sensitive areas of the property, and to install a tertiary septic treatment system to ensure water quality impacts are minimized.

The NEC mailed requests for comments on this proposed amendment to affected ministries, regional and local municipalities, conservation authorities, non-governmental organizations and interested parties.
A notice was also placed in the Collingwood Enterprise Bulletin newspaper on November 7, 2014.
