Effects of consultation
No comments were received in response to the Environmental Registry notice.
Ten letters of objection were received in response to the notification, circulation and consultation carried out under the Aggregate Resources Act (ARA). Concerns expressed by objectors related to: impacts to significant natural heritage features, operation noise, dust impacts, health concerns, impacts related to traffic and road safety, impacts on water quantity and quality, impacts on property values and operational matters. Most of the objections were addressed by the applicant through providing additional information and revisions to the proposed site plan.
One objection remained unresolved at the conclusion of the ARA resolution of objections stage. The unresolved was referred to the Ontario Municipal Board (OMB) for a hearing. The OMB directed the Minister to issue the licence subject to the site plans presented at the hearing.

This notice was updated on December 1, 2017 to advise the public that this application under the Aggregate Resources Act has been referred by the Ministry of Natural Resources and Forestry to the Ontario Municipal Board for a hearing. Please refer to http://elto.gov.on.ca/omb/ for further information on the status of the matter at the Ontario Municipal Board.
Description of instrument
G. Tackaberry and Sons Construction Company Limited has applied for a new licence to expand and operate two adjacent, licensed pits (Sly Pit and Dunkin Pit) as one operation. The new licence application is for a Category 1, Class A licence (Pit Below Water) to excavate aggregate from a pit 31.2 hectares in size with an annual tonnage condition of 300,000 tonnes.

G. Tackaberry and Sons Construction Company Limited currently operates the Sly Pit and the Dunkin Pit under the authority of licence No. 3944 and No. 4011 respectively under the Aggregate Resources Act. Presently these operations may remove no more than 20,000 tonnes of aggregate from each pit in any calendar year.
Site plan information is available to view at the Ministry of Natural Resources and Forestry Kemptville District Office. Making an appointment to view the information is recommended to ensure aggregate staff will be available to provide information and answer questions.

Comments received through the Environmental Registry should not be construed as an objection under the Aggregate Resources Act in accordance with section 4.0 – Notification and Consultation Standards of the Provincial Standards 1.0 under the ARA. To be considered as a formal objector, individuals need to contact the MNRF staff specified on this notice.
Other public consultation opportunities
As specified in the Aggregate Resources Act, written notice concerning this application was delivered to landowners within 120 metres of the proposed licenced boundary; an information sign, giving notice to the public of this application was erected at the proposed site; and a Notice of Application appeared in the local paper, the EMC, on July 30, 2015. A public information session was held on August 25, 2015 at 4:00 pm at the Lansdowne Community Hall, 1 Jessie Street, Lansdowne, Ontario.
The application for this proposal will be circulated within the MNRF Kemptville District office. Additionally, notification of this application will be forwarded to the United Counties of Leeds and Grenville, the Township of Leeds and the Thousand Islands, Cataraqui Region Conservation Authority, the Ministry of Agriculture, Food and Rural Affairs, and the Ministry of the Environment and Climate Change.
