Decision details

Aggregate Resources Act Licence # 625927 was issued to Lafarge Canada Inc. on February 25, 2020, subject to conditions specified on Schedule A (Prescribed Conditions). The licensed area is 44 hectares in size and the annual tonnage is limited to no more than 400,000 tonnes of aggregate removed from the site in any calendar year.

Effects of consultation

One comment was received in response to the Environmental Registry notice. This was a duplicate of a written objection that was submitted through the ARA process. Twelve (12) letters of objection were received in response to the Aggregate Resources Act (ARA) consultation process.  The objections were related to traffic, road degradation, lack of rehabilitation, noise and dust, berms/landscaping, loss of property value, technical components of the proposed site plans, entrance/exit location, noise mitigation, setbacks, hydrology, and erosion concerns.

The applicant worked to address the objections by providing additional information and revising the site plans. The application was referred to the Local Planning Appeal Tribunal (LPAT) to resolve one unresolved objection. The LPAT issued a written decision (MM190003) and directed the Minister of Natural Resources and Forestry to issue the licence subject to the site plans and conditions attached to the decision and order.

Description of instrument

Lafarge Canada Inc. has applied for a Category 1, Class A (Pit Below Water) licence to excavate aggregate from a pit of 44 hectares in size. This application is for the establishment of a new pit. The annual tonnage condition applied for is 400,000 tonnes.

As specified in the Aggregate Resources Act, written notice concerning this application was delivered to landowners within 120 metres of the proposed licenced boundary; an information sign, giving notice to the public of this application, was erected at the proposed site; and a Notice of Application appeared in the local paper, the Winchester Press and the Chesterville Record on October 28, 2015. A public information session will be held on November 30th, 2015 from 4:30pm to 7:30pm at the St. Andrew’s United Church, 10532 Church Rd, Mountain, Ontario.

The application for this proposal will be circulated within the MNRF Kemptville District office. Additionally, notification of this application will be forwarded to the United Counties of Stormont, Dundas and Glengarry, the Township of North Dundas, Rideau Valley Conservation Authoirty, Ministry of Natural Resources and Forestry, Ministry of the Environment and Climate Change, Ministry of Agriculture, Food and Rural Affairs, and TransCanada Pipelines Limited for comment.
