Effects of consultation

There were two (2) comments received on the Environmental Registry regarding this proposal. One comment referenced the A Blueprint for Change, a proposal to modernize and streamline the Aggregate Resources Act policy framework and was not specific to the application. The second comment was a request from Six Nations of the Grand River to meet with Dufferin Aggregates to discuss the proposal. To address the request, Dufferin Aggregates met with the Six Nations of the Grand River on five separate occasions between 2015 and 2018.

Seven (7) objections raised in the Aggregate Resources Act consultation process were related to protection of the natural environment, location of the processing plant and recycling area, noise and dust and the hours of operation. In order to address the concerns the applicant agreed to: modify the limit of extraction, complete ecological, noise and dust monitoring, reduce the hours of operation on Saturdays, placement of the main processing plant within Phase 1 of the adjacent Cedar Creek Pit, additional berming and tree screens and the establishment of ecological enhancements and linkages during final rehabilitation.All concerns were addressed in the process and the objections were withdrawn.

This notice was updated on December 6, 2018 to advise the public that there has been no change to the status of the proposal and it is still being considered. No additional opportunity for comment is being provided for at this time.

Description of instrument

Dufferin Aggregates a Division of CRH Canada Group Inc. has applied for a Class A licence to extract aggregate from above the water table in a pit that is 51.5 hectares in size with an extraction area of 40.4 hectares. This application is for the establishment of a new pit known as the Alps Pit. The annual tonnage condition applied for is 1,500,000 tonnes combined with the new licence application proposed on the adjacent site (Cedar Creek Pit).

Comments received through the Environmental Registry should not be construed as an objection under the Aggregate Resources Act  in accordance with section 4.0 – Notification and Consultation Standards of the Provincial Standards 1.0 under the ARA. To be considered as a formal objector, individuals need to contact the MNRF person specified on this notice to determine how to submit an objection.

As specified in the Aggregate Resources Act, written notice concerning this application was delivered to landowners within 120 metres of the proposed licenced boundary; an information sign, giving notice to the public of this application was erected at the proposed site; and a Notice of Application appeared in the local paper, the Ayr News, on September 28, 2016. A public information session was held on October 25, 2016 from 4:00pm to 7:00pm at the Ayr Fire Hall at 501 Scott Street, Ayr, ON N0B 1E0.

The application for this proposal has been circulated within the MNRF Guelph District office. Additionally, notification of this application has been forwarded to the Township of North Dumfries, Regional Municipality of Waterloo and the Grand River Conservation Authority.
