Decision details
An Order was issued to order employees of the Ministry of Energy, Northern Development and Mines to hire competent people to construct and operate a water treatment plant. A certified mine production closure plan exists for the facilities known as the MacLeod Mine. Constructing and operating a water treatment plant to treat acidic water at the property is required as part of the rehabilitation measures of the closure plan. Since the current owner of the property was unable to secure the funds to construct the water treatment plant in time to avoid a discharge to the natural environment, the Order was issued. |

Description of instrument
For the protection of the environment, and in the public’s interest, the Director of Mine Rehabilitation is proposing to issue a Director’s Order pursuant to subsection 145(2) of the Mining Act, to provide for the Crown to perform rehabilitation measures with respect to the MacLeod Mine. Upon the issuance of the Order, the Crown may access the financial assurance provided with the closure plan to carry out that work.
The Director has reasonable and probable grounds for believing that the required rehabilitation measures will not be carried out in accordance with the filed closure plan.
The Order would provide for the Crown to carry out rehabilitation measures and /or appoint an agent to do so, as the Director considers necessary.
The rehabilitation measure ordered will be the construction of a water treatment plant.
