Effects of consultation

The comments received were reviewed and where appropriate were considered in our decision on whether to proceed with this proposal. For this proposal two (2) comments were received in which the following concerns were raised:

  • please ensure conditions regarding requirements for a Public Liaison Committee continue to be included in the ECA
  • how will compliance be checked to ensure that the company is only accepting non-hazardous levels of hydrocarbon impacted soils
  • how will the Ministry ensure its officers can check for compliance regarding what is and is not acceptable

We addressed the public’s concerns by including the following terms and conditions in the amended Environmental Compliance Approval:

  • a requirement to continue to engage the affected community through the maintenance of a public liaison committee
  • a requirement to test and document the level of contamination in the soil at the source site
  • a requirement to retain all records regarding the operation of treatment process including the quantity of contaminated soil received at the site, the level of contamination in the soil, and soil testing results
