Exception summary

The regulation amendment allows for the issuance of occupational authority to existing cottagers in Rondeau Provincial Park to extend their term of occupation beyond 2017.

Why consultation isn't required

The Ministry has used EBR section 30(1) of the EBR to post notice of this Exception as the environmentally significant aspects of the proposal have already been considered in a process of public participation under the EBR or any other Act that was substantially equivalent to the process required under the EBR.

A policy proposal on extending the cottage lots in Rondeau Provincial Park was posted on the Environmental Registry in October 2010 for 45 days (ER#011-1300).

Exception details

Description of regulation

Subsection 13(2) of Ontario Regulation 347/07 has been amended to provide a two-staged approach to regulating occupations of cottage lots in Rondeau Provincial Park beyond December 2017. Ontario Regulation 347/07 previously stated that no person shall occupy land except under a lease (or other authorization) that does not extend beyond December 31, 2017.

The first stage of the new regulatory approach provides that, effective immediately, a person would be prohibited from occupying lands in Rondeau except under a lease (or other authorization) that expires on or before December 31, 2019. This amendment enables the Ministry of Natural Resources and Forestry (MNRF) to temporarily extend the term of occupation for existing cottagers for up to an additional two (2) years to December 31, 2019 while MNRF completes necessary work (e.g., environmental assessment and Indigenous consultation) related to its policy proposal to extend the occupation of cottage lots to December 31, 2038 (the “Rondeau Policy Proposal” – see ER#011-1300). MNRF will make a decision on that policy proposal once this necessary work is completed.

The second stage of the approach provides a further regulatory amendment, which is to take effect on July 1, 2019, such that a person would be prohibited from occupying lands in Rondeau except under a lease (or other authorization) that expires on or before December 31, 2038. This amendment will enable MNRF to extend the occupation of cottage lots beyond 2019 – to a date no later than December 31, 2038 – in the event that MNRF's future decision respecting the Rondeau Policy Proposal is supportive of a further extension.

Decision on regulation

Amendments to Ontario Regulation 347/07 were filed October 19, 2017 and will be published in the gazette on November 4, 2017.

MNRF considered comments received as part of the Rondeau Policy Proposal in developing the amendments to Ontario Regulation 347/07. MNRF will continue to consult with Indigenous communities, stakeholders, and the public before making a decision on the timeframe and conditions of occupations beyond 2019 up to December 31, 2038.
