Why consultation isn't required
Information regarding a previous regulation change made in 2007, through which a schedule listing certified traps was created, was posted on the Environmental Registry from February 26 – April 12, 2007. As noted in the following excerpt from that proposal notice, notification was given that the schedule would be updated in the future as more traps were tested and approved:
“Future changes to trapping regulations reflecting agreement on international humane trapping standards requirements will be achieved by amendments to Ontario Regulation 667/98. These changes will occur periodically to identify additional agreement on international humane trapping standards-compliant trapping devices.”
In light of the notification provided in 2007, a proposal notice for the regulation change in this note was not posted on the Environmental Registry; however, this information notice outlines the changes effected by the regulation.
Bulletin details
This regulatory amendment includes several new certified humane traps for lynx, beaver and muskrat, as well as humane certified traps for bobcat – a species that was not previously listed in the certified trap schedules in the trapping regulation. This amendment ensures that trappers are aware of certified humane traps that must be used to target these species.
All traps certified for bobcat are already mandatory for use for other furbearing species and trappers will generally already possess these certified traps. Adding to the list of agreement on international humane trapping standards compliant traps for other species results in an increase to trap options for trappers.
This list of agreement on international humane trapping standards humane certified traps for furbearers in Ontario can be found in schedules 1 and 2 of Ontario Regulation 667/98 (Trapping) under the Fish and Wildlife Conservation Act, 1997.
This updated regulation also ensures continued compliance with international obligations and is considered routine business process for the Ministry. This is the eighth amendment related to the agreement on international humane trapping standards since 2007, the first year provinces and territories were required to implement.
The Ministry has also made minor technical amendments to the trapping regulation for accuracy and clarity.
