Decision on instrument

The Poltawa Country Club is located on a 40 hectare property just outside of Terra Cotta in the Town of Caledon. It is one parcel of land divided into 106 residential lots.  Approximately 70 of the 106 lots are developed and serviced by a subsurface disposal system.  The Country Club has granted licenses to members or licensee(s) for the use of but not ownership of the lots.

The approval will replace existing approvals for the establishment, use and operation of year-round subsurface sewage works on the property owned by the Poltawa Country Club Corporation and is respective Licensee(s).

The consolidated approval will cover all proposed and existing approvals. There are currently eight subsurface systems covered by the approval.

The consolidated approval is expected to be amended in future to include new subsurface systems on existing and/or redeveloped residential lots.

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

  • decision that you wish to appeal
  • grounds for granting leave to appeal
