Bulletin summary

We amended the regulations under the Environmental Bill of Rights, 1993 (EBR) to make sure they align with the government’s structure, and to update references to amended or repealed legislation

Why consultation isn't required

We made administrative amendments to the regulations under the EBR to ensure they align with recent legislative changes, and changes to ministry mandates.

The amendments include:

  • updating references to reflect current ministry names and responsibilities
  • amending and removing references to amended or repealed legislation

We did not consult on these amendments as they are administrative in nature.

Bulletin details

There are two regulations under the EBR:

  • General Regulation (Ontario Regulation 73/94), sets out which ministries are subject to the EBR
  • Instrument Classification Regulation (Ontario Regulation 681/94), provides which instruments (such as approvals, permits or orders) are subject to the public notice and consultation provisions under the EBR

We amended both regulations to align with recent administrative and legislative changes.

Summary of changes to Ontario Regulation 73/94 (General Regulation)

This regulation prescribes ministries and statutes for the purposes of the EBR. The changes;

  • update ministry names to align with current ministry names and mandates
  • remove references to the repealed statutes, such as the Green Energy Act, 2009 and the Climate Change Mitigation and Low-carbon Economy Act, 2016
  • removes references to revoked sections of legislation
  • consequential amendments as a result of amendments to the EBR

Summary of changes to Ontario Regulation 681/94 (Instrument Classification)

This regulation classifies instruments (such as approvals, permits or orders) for the purposes of the EBR. The changes to the regulation include amending headings to reflect current ministry names, transferring responsibility of instruments to reflect current ministry mandates, and removing references to revoked sections of legislation.

These amendments are effective April 1, 2019.
