Decision details

On October 10, 2019 we approved a new Environmental Compliance Approval No. 3185-BE8NEM for Brendar Environmental Inc., for a municipal and subject waste transfer and processing site, located in the Loyalist East Business Park, Bath, ON.

The facility will reinforce services to local municipalities, residents and industries by offering a local solution for managing hazardous and liquid industrial wastes. The function of the site is to receive, process, and transfer household hazardous, industrial hazardous, liquid industrial, and non-hazardous industrial wastes. All inbound and outbound waste shipments will be in compliance with applicable waste regulations and legislation.

The total amount of waste materials accepted at the site will not exceed 92 tonnes per day and the maximum storage capacity will not exceed 92 tonnes at any one time (comprised of all waste types combined). No materials will be disposed of at this site, but will be transferred for further processing or final disposal at appropriately licensed downstream facilities. On-site processing will consist primarily of re-packaging, bulking and/or solidification of waste materials including, but not limited to, paint, oil, solvents, anti-freeze, contaminated materials (soils and debris), aerosol cans and fluorescent tubes.

The facility will operate primarily during regular business hours (7am-7pm), however will be permitted for operation 24 hours a day, 7 days a week. The facility will primarily serve the Province of Ontario, but will also be permitted to receive from Manitoba and Quebec.

You’ll need to prepare an application. You may wish to include the following things in your application:

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Description of instrument
