Decision details

On April 18, 2019 we approved new Environmental Compliance Approval (Waste Disposal Site) for the following: The use and operation of a private waste transfer and waste processing facility, to be used for processing and transfer of intact waste batteries taking place in a 1,900 square metres facility located within a 12,000 square metres building, where intact waste batteries will be received, sorted, and repacked and consolidated for shipment.

In addition, Nickel Cadmium Wet Cell batteries will be screened, set aside, and disassembled into their component parts for other users.

The total maximum amount of waste will be 100 tonnes per day with a maximum storage capacity of 300 tonnes at any one time. The site will service Canada and the United States of America and will be opened 24 hours a day, Monday to Sunday. Shipping and Receiving hours of 7:00 a.m. to 8:00 p.m., Monday to Friday.

You’ll need to prepare an application. You may wish to include the following things in your application:

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal
