Update Announcement
Under the Environmental Bill of Rights,1993, an Environmental Compliance Approval (ECA) is considered a class II instrument proposal. As a class II instrument proposal, the ministry is required to provide the public with a minimum 30-day public review and comment period plus some other form of notice. On August 20, 2019, the ministry provided notice directly to the following individuals in order to meet our obligations for a class II instrument proposal; Mayor of the township; Other township officials (CAO Township of Wellesley); and The Member of Provincial Parliament

Decision details
On September 6, 2019 we approved a new Environmental Compliance Approval No. 3807-BEKKZ2 for 581777 Ontario Limited for a new on-site sewage works for the treatment and disposal of sanitary wastewater and kitchen wastewater generated from an existing restaurant, motel and residence located at 3006 Lobsinger Line in Township of Wellesley, Ontario.
The sewage works is designed with a maximum daily flow of 16,600 L/day, including two 4,500 L new grease interceptor tanks in series, two septic tanks and pump chambers, one 14,850 L flow equalization tank, sludge storage tank/primary clarifier, moving bed bioreactor #1(Bioreactor #1), one 12,600 L intermediate clarifier tank, moving bed bioreactor #2 (Bioreactor #2), one 10,900 L secondary clarifier tank, denitrification unit/polisher bioreactor, a supplemental carbon source dosing system for denitrification, one 12,600 L final clarifier tank, one 10,900 L disposal pump tank, one set of shallow buried trench disposal system with 528 m of infiltrator chambers.
Effects of consultation
We received one comment requesting for effluent limitation as well as effluent monitoring. We addressed this by imposing effluent objectives and effluent monitoring in the issued Environmental Compliance Approval.

Appeal process for decisions published before June 1, 2021
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

Proposal details
This proposal is for a new Environmental Compliance Approval for the establishment of year round subsurface disposal works rated at 16,600 L/day, to service an existing restaurant, existing motel and existing residence located at 3006 Lobsinger Line in Township of Wellesley, Ontario.
The proposed works include grease inceptor tanks, settling tanks, equalization tank, moving bed biofilm bioreactors, dinitrification and polishing, with subsurface disposal to shallow buried trenches.
The Ministry may require effluent monitoring and may impose effluent limits
