Bulletin summary

We have removed a Minister's Zoning Order (MZO) in the City of Welland, filed as Ontario Regulation 322/16 as it is no longer needed.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to a proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke a MZO under subsection 47(8) of the Planning Act.

Details of bulletin:

The MZO was originally put in place in 2016 to facilitate the development of a manufacturing facility which has since been built. Local zoning for the facility has come into effect and reflects the MZO provisions.

Section 47 of the Planning Act authorizes the Minister of Municipal Affairs and Housing to makeMZOs in order to regulate land use on any land in Ontario. An MZO prevails over local zoning-by-laws where there is a conflict.

The minister is also authorized under section 47 of the Act to amend of revoke the MZO, at any time.

A public notice must be given prior to a decision being made regarding revocation of the MZO, as required under section 47(9) of the Act.

A public notice and request for comments was posted in the Welland Tribune and the Le Regional regarding the proposed removal of the MZO on June 27, 2019 for a 20-day commenting period. No comments from the public were received during the commenting period.
