Roseson Distributors' request  to build a gas station and install the  aboveground fuel storage tanks 12 metres from a ditch is approved.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1783 for public comment from May 15, 2020 to June 14, 2020 . To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Bulletin details

The client will install a 35,000-litre and a 9,500-litre double-wall aboveground storage tank inside a concrete dike (a barrier surrounding the aboveground storage tanks that provides liquid retention capacity). The dike will meet the construction requirements in section 3.3.1.3 of the LFHC.  This solution will provide triple-wall containment of the fuel.  Three walls provide substantial protection from a potential fuel leak into the environment.
