Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1759 for public comment from May 7, 2020 – June 6, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Location details
The properties are described as Parcel 11305, Location NT 88 and 89, on Otter Lake, in the Unincorporated Township of Rudd, in the District of Kenora.
The subject property is roughly 40 km northwest of the City of Kenora.

Decision details
The Application for Consent File No. 60-C-207296 for a lot addition was draft approved on June 26, 2020 subject to standard conditions.
The purpose of the application for a lot addition was to transfer a vacant 0.44-hectare portion of land to the abutting west lot described as Location NT 88. This will increase its size from 0.70 to 1.14 hectares. Retained on NT 89 will be a property of approximately 1.48-hectares in size. Both the severed and retained properties contain a cabin serviced by a combination of class 1 and 2 sewage systems and lake water. No additional development is proposed.
The application has regard for the provincial interests as referred to in Section 2 of the Planning Act, is consistent with the Provincial Policy Statement, 2020, conforms to the Growth Plan for Northern Ontario and has regard for Section 51(24) of the Planning Act.
