Bulletin summary

We have approved a new Environmental Compliance Approval No. 2527-BRTTXS to 2485097 Ontario Inc. for the establishment of stormwater management works for the proposed light industrial development, located at 7896 Huntington Road, in the City of Vaughan, Ontario.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on April 30, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO # 019-1723 for public comment from April 30, 2020 - June 14, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details

Stormwater management works is proposed for the collection, treatment and disposal of stormwater run-off from catchment areas within the 1.05 ha site to attenuate post-development peak flows to a controlled flow rate of 148.5 L/s (which is less than the allowable release rate of 167.4 L/s), discharging via an existing service connection manhole along Huntington Road, to an existing off-site stormwater management pond located at the end of Motion Court 131 (north east quadrant of the Block 64 Plan) which provides quality control and quantity control for the site, consisting of the following:

  • rooftop storage at the 2797 square metres rooftop area
  • surface ponding Storage located within 950 squre metres of the parking lot, discharging via storm sewer system equipped with a 150 mm diameter orifice, allowing a maximum discharge of 139.5 L/s under the 100-year storm event to municipal storm sewers located along Huntington Road and ultimately to an existing off-site stormwater management pond located at the end of Motion Court 131
  • infiltration trench to achieve water balance, required to retain 5 mm storm event onsite

Effects of consultation

Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect. On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak which exempts all proposals from the requirement to post notices on the ERO. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
