Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1925 for public comment from June 11, 2020 to July 11, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.
Bulletin details
On September 4, 2020 the ministry issued an exploration permit approximately 68 kilometers south east of Chapleau, Ontario to conduct early exploration activities.
This permit will allow the company to conduct Mechanized Stripping (greater than 100 square metres in a 200 metres radius).
The exploration permit was issued once all Indigenous communities and the public had the opportunity to provide comment or raise their concerns. The issued exploration permit is valid for a period of three years from the date of issue.

The mining activities are located approximately 68 kilometers south east of Chapleau, Ontario, in Township of Fawn, Territorial District of Sudbury, Northeast Region.

No comment was received through the Environmental Registry of Ontario resulting in no impact on the decision to proceed or not with this proposal.
Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect.
