Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the Environmental Bill of Rights until 30 days after the declared emergency is terminated.
Although consultation was not required, the ministry did consult with the public on this proposal by posting Environmental Registry of Ontario number 019-1872 for public comment June 2, 2020 to July 2, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.
Bulletin details
On September 9, 2020 the ministry issued an exploration permit for mining activities 162 kilometres northeast Smooth Rock Falls, Ontario, in Atkinson Lake Area, Kingroy Lake Area townships, District of Cochrane, Northeast Region. This permit will allow the company to carry out the following activities:
- mechanized drilling (where the drill weight is greater than 150 kilograms)
The exploration permit was issued once all Indigenous communities and the public had the opportunity to provide comment or raise their concerns. The issued exploration permit is valid for a period of three years from the date of issue.

Third parties are not able to apply for leave to appeal in respect of proposals which are posted while Ontario Regulation 115/20 is in effect.
