Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.*
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1848 for public comment from June 12, 2020 – June 12, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Notice of this decision was issued on October 21, 2020 to the Regional Municipality of Peel.

Effects of consultation
Public Consultation on adopted Regional Official Plan Amendment 33 was provided for 30 days, from June 12, 2020 to July 12, 2020.
As a result of public consultation on the adopted Regional Official Plan Amendment, the Ministry received one comment through the Environmental Registry of Ontario related to the need to protect natural heritage and agricultural lands and consider climate change.
Future development in this area will need to comply with Regional policies related to environmental protection.
Appeals are not allowed
Pursuant to subsection 17 (36.5) and (38.1) and subsection 21(3) of the Planning Act, the decision of the Minister of Municipal Affairs and Housing regarding Official Plan Amendment 33 adopted in accordance with Section 17 and Section 26 is final and not subject to appeal. Accordingly, the Official Plan Amendment 33, as approved by the Minister, came into effect on October 20, 2020.
