Bulletin summary

We issued an Environmental Compliance Approval with Limited Operational Flexibility (Air) to The Electromac Group Inc., a facility that uses forged tool steel and tool grade castings for tool production and steel coils for production stampings, located in Windsor, Ontario.

Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.

Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on June 4, 2020 while Ontario Regulation 115/20 was in effect.

Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1866 for public comment from June 4, 2020 to July 19, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision details

We issued an Environmental Compliance Approval with Limited Operational Flexibility (Air), which replaced all the current Environmental Compliance Approvals for air emission sources at this facility, including the addition of new, or historically unapproved, sources for air emissions from The Electromac Group Inc. The facility uses forged tool steel and tool grade castings for tool production and steel coils for production stampings, and is located in Windsor, Ontario.

The approval includes all air emission sources at the facility, including:

  • ten (10) cold presses
  • three (3) spot welders
  • one (1) maintenance welder

Emissions to the air from this facility include:

  • nitrogen oxides
  • chromium compounds
  • iron oxide
  • nickel
  • suspended particulate matter

The Environmental Compliance Approval with Limited Operational Flexibility (Air) permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air).

The limited operational flexibility conditions have an expiry date. The company is required to make an application for amendment at that time to renew these conditions.

We did not receive any comments from the public during the EBR commenting period.

Since we did not receive any comments from the public during the EBR commenting period, there is no impact of public comment on the approval decision.

Effect of consultation

Third parties are not able to apply for leave to appeal in respect of proposals which were posted while Ontario Regulation 115/20 was in effect between April 1, 2020 and June 14, 2020. Ontario Regulation 115/20 exempted all proposals for instruments from posting requirements under the EBR. Leave to appeal may only be sought in respect of instruments that are required to be posted to the ERO.
