Decision details

We issued Environmental Compliance Approval No. 3234-CKML66 on August 21, 2023 to H & D Properties Ltd. for the operation of an anaerobic digester facility located at 1336 County Road 2, Maitland, Ontario.

Organic feedstock consisting of residues from source separated organics, and industrial, commercial and institutional sources will be processed through the anaerobic digesters to produce renewable natural gas, for injection into the natural gas grid, and liquid digestate for use as organic fertilizer. All organic feedstock will be delivered to the facility via truck deliveries.

The subject approval includes all emission sources from the facility discharging to the air and includes the following:

  • a fully enclosed receiving building for the receipt of organic residuals feedstock
  • an odour control system, serving the organic feedstock receiving building, utlitizing activated carbon, and consisting of:
    • three treatment trains - two duty and one standby
    • a continuous emission monitoring system for hydrogen sulphide
  • two hybrid anaerobic digester tanks, each tank having a hydrolyzer component, anaerobic digestion component, and pasteurizer component, and served by two natural gas-fired boilers, an emergency flare and emergency pressure release valve
  • two liquid surge tanks, to provide storage for liquid feedstock, and each tank served by:
    • an activated carbon adsorption odour control unit
    • a continuous emission monitoring system for hydrogen sulphide
  • a natural gas-fired boiler serving the organic feedstock receiving building
  • a biogas upgrading system, served by activated carbon adsorption odour control

Contaminant emissions to the air include total reduced sulphur, nitrogen oxides, sulphur dioxide, particulate matter, carbon dioxide, and methane.

Effects of consultation

A total of 72 comments were received from the public regarding the air and noise emissions resulting from the proposed operation of an anaerobic digester facility by H & D Properties Ltd. located at 1336 County Road 2, Maitland, Ontario. These comments raised concerns regarding:

  • emissions of odorous contaminants from the proposed facility
  • noise emissions from the proposed facility’s operation, including on-site equipment and truck movements/activities
  • public health and safety
  • effect on local property values
  • protection of the natural environment
  • effect of local wildlife

An Emission Summary and Dispersion Modelling (ESDM) Report and Acoustic Assessment Report (AAR) were submitted in support of the proposal to document all air and noise emissions, respectively, resulting from the operation of the facility.

The Ministry’s Air Approvals Unit and Noise Approvals Unit completed a detailed assessment of the above-noted ESDM Report and AAR, and found them to be compliant:

  • Ontario Regulation 419/05: Air Pollution – Local Air Quality
  • Publication NPC-300, Environmental Noise Guideline, Stationary and Transportation Sources – Approval and Planning
  • all other applicable ministry policy and guidelines

The Environmental Compliance Approval issued to H & D Properties Ltd. for the operation of the equipment included conditions to ensure an adverse effect is not caused as a result of the air and noise emissions resulting from the operation of the facility. These conditions include:

  • source testing of odorous sources
  • identification of odour control measures
  • proper operation and maintenance of odour control equipment
  • development of an odour management plan to minimize odour impacts
  • development of a negative pressure assessment plan to ensure negative pressure is maintained at the organic feedstock receiving building
  • implementation of noise control measures as outlined in the AAR
  • completing an acoustic audit following commencement of facility operations to verify noise impact and compliance

The remaining comments regarding public health and safety, effect on local property values, protection of sub-surface and surface resources, and effect on local wildlife are outside the jurisdiction of section 9 of the Environmental Protection Act, Ontario Regulation 419/05, and NPC-300, and are not related to the issuance of this approval for air and noise emissions from the facility.

Proposal details

This proposal is for a new Environmental Compliance Approval (air) for H & D Properties Ltd., an anaerobic digestion facility located in the Township of Augusta, United Counties of Leeds and Grenville.

This application includes all emission sources from the facility that exhaust to the atmosphere including odour control, two (2) natural gas-fired boilers, biogas upgrader, emergency flares, an anaerobic digester equipped with an emergency pressure relief valve.

Contaminant emissions to the atmosphere include:
