Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempted all proposals for policies, acts, regulations and instruments from posting requirements under the EBR.
Ontario Regulation 115/20 was revoked on June 15, 2020, however, we are posting this decision as a bulletin because the proposal was posted on May 13, 2020 while Ontario Regulation 115/20 was in effect.
Although consultation was not required, the ministry did consult with the public on this proposal by posting ERO# 019-1777 for public comment from May 13, 2020 to June 27, 2020. To ensure transparency, the ministry is providing details of its decision and the effects of consultation on decision-making in this notice.

Instrument decision
This is approval for the establishment of sewage treatment and year round subsurface sewage disposal works, servicing Walinga Inc., for domestic sewage.
The approved sewage works comprised of:
- submersible sump pumps
- pump chambers
- discharge piping and forcemain
- liquid level sensors
- a treatment system
The subsurface sewage disposal works are rated at 20,000 litres per day, and include:
- two septic tanks
- three biofilter tanks
- two denitrification units
- dispersal bed
Comments received
One comment was received through the Registry with concerns regarding the property's location in a Wellhead Protection Area.
Effects of consultation
The comment provided was considered in the subject approval. Applicants were consulted to review the comment and confirm the findings. The applicants have confirmed that Trichloroethylene (TCE), the chemicals that degrade to TCE or Vinyl Chloride are not used at the facility.
