Decision details

The applicant's design for the solidification pit and updated Design and Operations Report to ensure the site can be operated and maintained in a manner which does not present a hazard to the health and safety of the public and the environment.

There is no change in any of the waste processing procedures as part of this application.

Many improvements were made on the pit's previous design to provide additional protection against any potential for adverse effect and as a result, the ministry is satisfied with the design of the pit and its ability to perform the waste management operations as approved.

As a result of this amendment, an updated Environmental Compliance Approval has been issued that revokes and replaces the existing approval.

Appeal process for decisions published before June 1, 2021

Seek leave to appeal

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Proposal details

This proposal is for an amendment to an existing Environmental Compliance Approval (ECA) No. 6625-6EMMZ3 for a waste disposal site (transfer/processing), with a total area of 2.0 hectares, located at 141 Prosperity Way, Chatham-Kent, Ontario.

The facility is currently used for the processing and transfer of municipal non-hazardous solid waste, hazardous waste, and liquid industrial waste, up to 300 tonnes per day of non-hazardous solid waste, 100 tonnes per day of hazardous solid waste, and 300 cubic metres of liquid industrial waste, and 100 cubic meters of hazardous liquid waste.

The total amount of waste and processed materials stored at the site will not exceed: 900 tonnes of non-hazardous solid waste,100 tonnes of hazardous solid waste, 800 cubic metres of liquid industrial waste,100 cubic metres of hazardous liquid waste at any one time. This waste disposal site is to serve Canada and the USA.

Veolia ES Canada Industrial Services Inc. is applying for a minor amendment to their above cited ECA for the replacement of their solidification pits. Both pits were redesigned and re-constructed on the site in the same relative location within the coverall building. The solidification pits were constructed out of reinforced concrete underlain with a synthetic liner for additional environmental protection. They were designed to allow the driver and front loader to drive into the pits thereby reducing risk of spills, eliminating a confined space and allowing safer operations.

No changes to the type or volume of waste received, treated or stored will occur as a result of this amendment.
