What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  2. could the decision you wish to appeal result in significant harm to the environment?

Note: This notice was originally published with a 45 day comment period ending April 26, 2021.  The comment period was extended for another 15 days. We have extended the comment period for another 30 days on May 7, 2021.

 

This proposal is for an Environmental Compliance Approval with Limited Operational Flexibility (air) which replaces all the current Environmental Compliance Approvals for Air at this facility, and includes the addition of new or historically unapproved sources for all emissions from Rain Carbon Canada Inc., a coal tar and petroleum-based material processing facility located in the City of Hamilton, Ontario.

The proposal is for all sources at the facility, including the receiving, handling, distillation, and storage of materials, as well as emissions from all supporting equipment and processes at the site.

This proposal is for:

  • the addition of one new storage tank
  • the addition of one venting system at the Tanker Truck Loading Area
  • updates to the processes and discharge rates at the facility

Contaminant emissions to the atmosphere include:

  • polycyclic aromatic hydrocarbons
  • sulphur compounds
  • benzene
  • napthalene
  • nickel
  • suspended particulate matter
  • nitrogen oxides

The Environmental Compliance Approval with Limited Operational Flexibility (air), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Page 2 Flexibility (air).

The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.
